One does have to consider films from a private collection used to make a
commercial tape. I suppose one could always write the producer for permission.
But then, suppose his contributors of material say no? A sticky situation,
indeed.
I have made copies of commercially produced videos so I could watch, rewatch and
watch again, pause, search, etc. without harming the original copy. But I always
wind up re-recording over the dubbed tape with other material from television,
etc. so it isn't the same as distributing copies, though I have done so in the
past.
