All true, Rich. I agree 100%. I remember an incident here where a bus fan 
was told he was not allowed to take photos of buses entering and leaving the 
Greyhound depot due to "passenger privacy issues." He laughed off the 
private security people and challenged them to call the police. They 
retreated.

But in the case of our hospital, photography is restricted to patient's 
rooms, cubicles, etc. and not in "common areas" where other patients may 
inadvertently enter the frame.

Our Trauma Resuscitation Department has a policy of no unofficial 
photography within the treatment area. It is due to a visitor attempting to 
photograph a celebrity who was sleeping in an adjacent cubicle in 
pre-H.I.P.P.A. days. Police and medical photography is allowed in there. The 
policy has been reviewed and upheld by the County D.A. due to the layout of 
the area, which is basically wide open except for curtains around the post 
treatment or suturing beds.

The other issue we have had has been T.B.I. patients giving consent to the 
family for taking photographs of them in the TICU unit and then claiming 
they had no recollection of giving permission after their recovery. After 
seeing the photos taken by his spouse and children, one individual attempted 
to sue the hospital.

But like you stated, educational photos are always taken. Quite often, our 
department is loaning our camera to surgery, the E.D. and the ICU Quad for 
such use when they forget to charge their batteries.

I just have an issue with people harassing other people because they believe 
they can, like the UTA person telling you Homeland Security banned "railroad 
photography."
